Dar, ca orice lucru rom\u00e2nesc, nici \u00een aceast\u0103 situa\u021bie lucrurile nu sunt at\u00e2t de simple pe c\u00e2t par.<\/font><\/p>\n<p align=\"justify\"><font face=\"Arial\" size=\"3\">Oricine poate constata c\u0103&nbsp; orice trotuar pe de teritoriul Rom\u00e2niei, fie c\u0103 e la ora\u0219, la \u021bar\u0103 sau \u00een v\u00e2rful muntelui unde nici nu sunt trotuare, este ocupat de nenum\u0103rate ma\u0219ini.<\/font><\/p>\n<p align=\"justify\"><font face=\"Arial\" size=\"3\"><a href=\"https:\/\/infokam.eu\/blog\/wp-content\/uploads\/2018\/03\/P1190700.jpg\"><img loading=\"lazy\" decoding=\"async\" width=\"600\" height=\"451\" title=\"P1190700\" style=\"display: inline; background-image: none;\" alt=\"P1190700\" src=\"https:\/\/infokam.eu\/blog\/wp-content\/uploads\/2018\/03\/P1190700_thumb.jpg\" border=\"0\"><\/a><br \/>\n<\/font><\/p>\n<p align=\"justify\"><font face=\"Arial\" size=\"3\">Exist\u0103 o veche legend\u0103 rom\u00e2neasc\u0103 c\u0103reia i s-au pierdut originile, \u00een care se poveste\u0219te c\u0103 dac\u0103 la\u0219i l\u00e2ng\u0103 ma\u0219in\u0103 un spa\u021biu de minim 1 metru pentru trecerea pietonilor ai voie s\u0103 parchezi pe trotuar<\/font><\/p>\n<p align=\"justify\"><font face=\"Arial\" size=\"3\">Mai mult, exist\u0103 chiar oficialit\u0103ti care \u00eencurajeaz\u0103 parcarea pe trotuare <\/font><\/p>\n<p align=\"justify\"><a href=\"https:\/\/voceatimisului.ro\/aberant-soferii-din-timisoara-amendati-ca-parcheaza-pe-trotuare-intre-blocuri-lipsa-parcarilor\/\"><img loading=\"lazy\" decoding=\"async\" width=\"600\" height=\"169\" title=\"Clipboard02\" style=\"display: inline; background-image: none;\" alt=\"Clipboard02\" src=\"https:\/\/infokam.eu\/blog\/wp-content\/uploads\/2018\/03\/Clipboard02-1.jpg\" border=\"0\"><\/a><\/p>\n<p align=\"justify\"><font face=\"Arial\" size=\"3\">Adev\u0103rul este c\u0103 de fapt parcarea pe trotuar nu a fost permis\u0103 niciodat\u0103, toat\u0103 povestea se datoreaz\u0103 ata\u0219amentul pe care \u00eel au \u0219oferii pentru folclorul rom\u00e2nesc \u0219i unei interpret\u0103ri gre\u0219ite a textelor de lege.<\/font><\/p>\n<p align=\"justify\"><font face=\"Arial\" size=\"3\">S\u0103 vedem despre ce este vorba:<\/font><\/p>\n<p align=\"justify\"><font face=\"Arial\" size=\"3\">Legea aplicabil\u0103 \u00een privin\u021ba parc\u0103rii este <strong>OUG 195\/2002 republicata privind circulatia pe drumurile public, actualizata prin OUG nr. 63\/2006<\/strong><\/font><\/p>\n<p align=\"justify\"><font face=\"Arial\" size=\"3\">Iat\u0103 ce se spune \u00een acest text, la art. 72:<\/font><\/p>\n<p align=\"justify\"><font color=\"#000000\" face=\"Arial\" size=\"3\"><em>Art. 72<\/em><\/font><\/p>\n<p align=\"justify\"><font color=\"#000000\" face=\"Arial\" size=\"3\"><em>(7) Este interzisa ocuparea trotuarelor cu vehicule imobilizate, iar cand aceasta este permisa, conform indicatoarelor sau marcajelor, latimea minima a trotuarului lasat la dispozitia pietonilor trebuie sa fie de cel putin un metru.<\/em><\/font><\/p>\n<p align=\"justify\"><a href=\"https:\/\/infokam.eu\/blog\/wp-content\/uploads\/2018\/03\/indicator-parcare-trotuar.jpg\"><font face=\"Arial\"><strong><img loading=\"lazy\" decoding=\"async\" width=\"185\" height=\"239\" title=\"indicator-parcare-trotuar\" style=\"border: 0px currentcolor; border-image: none; margin-right: auto; margin-left: auto; float: none; display: block; background-image: none;\" alt=\"indicator-parcare-trotuar\" src=\"https:\/\/infokam.eu\/blog\/wp-content\/uploads\/2018\/03\/indicator-parcare-trotuar_thumb.jpg\" border=\"0\"><\/strong><\/font><\/a><\/p>\n<h1 align=\"center\"><font face=\"Arial\"><font style=\"font-weight: bold;\">SAU \/ \u0218I<\/font><\/font><\/h1>\n<p align=\"justify\"><em><font color=\"#000000\"><br \/>\n<\/font><\/em><\/p>\n<p align=\"justify\"><\/p>\n<p align=\"justify\"><font face=\"Arial\" size=\"3\"><a href=\"https:\/\/infokam.eu\/blog\/wp-content\/uploads\/2019\/07\/marcaj.jpg\"><img loading=\"lazy\" decoding=\"async\" width=\"600\" height=\"449\" title=\"marcaj\" style=\"display: inline; background-image: none;\" alt=\"marcaj\" src=\"https:\/\/infokam.eu\/blog\/wp-content\/uploads\/2019\/07\/marcaj_thumb.jpg\" border=\"0\"><\/a><br \/>\n<\/font><\/p>\n<p align=\"justify\"><font face=\"Arial\" size=\"3\"><strong>Regulamentul pentru aplicarea OUG 195\/2002 privind circulatia pe drumurile publice<\/strong>, adic\u0103 traducerea pentru cei mai s\u0103raci cu duhul a OUG 195\/2002, spune la art. 144:<\/font><\/p>\n<p align=\"justify\"><font color=\"#000000\" face=\"Arial\" size=\"3\"><em>Art. 144<\/em><\/font><\/p>\n<p align=\"justify\"><font face=\"Arial\" size=\"3\"><font color=\"#000000\" face=\"Arial\" size=\"3\"><em>(2) Administratorul drumului public poate permite oprirea sau stationarea, partial sau total, a unui vehicul pe trotuar, cu respectarea marcajului, iar in lipsa acestuia, numai daca ramane liber cel putin un culoar de minimum 1 m latime inspre marginea opusa partii carosabile, destinat circulatiei pietonilor.<\/em><\/font><\/font><\/p>\n<p align=\"justify\"><font face=\"Arial\" size=\"3\">Dac\u0103 punem \u201ccap la cap\u201d cele dou\u0103 texte ajungem la urm\u0103toarele concluzii:<\/font><\/p>\n<p align=\"justify\"><font face=\"Arial\" size=\"3\">1. Parcarea pe trotuare este de regul\u0103 interzis\u0103, dar poate fi permis\u0103, \u00eens\u0103 <font color=\"#ff0000\"><strong>numai&nbsp; dac\u0103 spa\u021biul respectiv este semnalizat sau marcat \u0219i dac\u0103 spa\u021biul l\u0103sat pentru pietoni este de minim 1 metru<\/strong><\/font> (OUG 195).<\/font><\/p>\n<p align=\"justify\"><font face=\"Arial\" size=\"3\">2. Se permite parcarea chiar dac\u0103 lipse\u0219te marcajul dar numai dac\u0103 se las\u0103 un spa\u021biu de 1m (Regulamentul de aplicare)<\/font><\/p>\n<p align=\"justify\"><font face=\"Arial\">Dar aten\u021bie, chiar dac\u0103 poate lipsi marcajul, a\u0219a cum spune regulamentul,<strong><font color=\"#ff0000\"> trebuie totu\u0219i ca parcarea aceea s\u0103 fie semnalizat\u0103<\/font><\/strong>, a\u0219a cum spune OUG-ul, sau dac\u0103 semnalizarea lipse\u0219te trebuie s\u0103 existe marcajul, niciunde \u00een cele dou\u0103 documente nu se spune c\u0103 parcarea este permis\u0103 \u00een lipsa marcajului sau\/\u0219i a semnaliz\u0103rii.<\/font><\/p>\n<p align=\"justify\"><a href=\"https:\/\/infokam.eu\/blog\/wp-content\/uploads\/2018\/03\/indicator-parcare-trotuar-1.jpg\"><img loading=\"lazy\" decoding=\"async\" width=\"185\" height=\"239\" title=\"indicator-parcare-trotuar\" style=\"border: 0px currentcolor; border-image: none; margin-right: auto; margin-left: auto; float: none; display: block; background-image: none;\" alt=\"indicator-parcare-trotuar\" src=\"https:\/\/infokam.eu\/blog\/wp-content\/uploads\/2018\/03\/indicator-parcare-trotuar_thumb-1.jpg\" border=\"0\"><\/a><\/p>\n<p align=\"justify\"><font face=\"Arial\" size=\"3\">Unele oficialit\u0103\u021bi au \u00een\u021beles c\u0103 parcarea este permis\u0103 dac\u0103 spa\u021biul l\u0103sat pietonilor este de minim 1m, chiar dac\u0103 lipse\u0219te marcajul sau\/\u0219i semnalizarea.&nbsp; <\/font><\/p>\n<p align=\"justify\"><font face=\"Arial\" size=\"3\"><font face=\"Arial\" size=\"3\">A\u0219a se \u00eent\u00e2mpl\u0103 c\u00e2nd interpretarea legii este l\u0103sat\u0103 unor persoane care au dificult\u0103\u021bi \u00een \u00een\u021belegerea unui text citit \u0219i a c\u0103ror p\u00e2ine pe mas\u0103 depinde de votul \u0219oferilor.<\/font><\/font><\/p>\n<p align=\"justify\"><font face=\"Arial\" size=\"3\"><br \/>\n<\/font><\/p>\n<p align=\"justify\"><font face=\"Arial\" size=\"3\"><a href=\"https:\/\/infokam.eu\/blog\/wp-content\/uploads\/2018\/03\/P1190891.jpg\"><img loading=\"lazy\" decoding=\"async\" width=\"600\" height=\"451\" title=\"P1190891\" style=\"display: inline; background-image: none;\" alt=\"P1190891\" src=\"https:\/\/infokam.eu\/blog\/wp-content\/uploads\/2018\/03\/P1190891_thumb.jpg\" border=\"0\"><\/a><\/font><\/p>\n<p align=\"justify\"><font face=\"Arial\" size=\"3\">Ceea ce nu au \u00een\u021beles autorit\u0103\u021bile este c\u0103 <strong><font color=\"#ff0000\">un regulament de aplicare, adic\u0103 ni\u0219te explica\u021bii ale legii, nu poate \u00eenc\u0103lca legea propriuzis\u0103.<\/font><\/strong><\/font><\/p>\n<p align=\"justify\"><font face=\"Arial\" size=\"3\">Deci, <font color=\"#ff0000\"><strong>parcarea pe trotuar nu este permis\u0103 dec\u00e2t dac\u0103 locul este semnalizat sau\/\u0219i marcat<\/strong><\/font>.<font face=\"Arial\" size=\"3\"><br \/>\n<\/font><\/font><\/p>\n<p align=\"justify\"><font face=\"Arial\" size=\"3\">Oricum aceast\u0103 ambiguitate a fost eliminat\u0103 prin <a href=\"http:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/184971\"><font color=\"#0000ff\"><strong>HG 965\/2016<\/strong><\/font><\/a>:<\/font><\/p>\n<p align=\"justify\"><font face=\"Arial\" size=\"3\"><font color=\"#000000\" face=\"Arial\" size=\"3\"><em>6. La articolul 144, alineatul (2) se modific\u0103 \u0219i va avea urm\u0103torul cuprins:<\/em><\/font><\/font><\/p>\n<p align=\"justify\"><font face=\"Arial\" size=\"3\"><font color=\"#000000\" face=\"Arial\" size=\"3\"><em>(2) Administratorul drumului public poate amenaja pe anumite zone ale trotuarului, <strong>CU AVIZUL POLITIEI RUTIERE<\/strong>, spa\u021bii destinate opririi sau sta\u021bion\u0103rii vehiculelor, <strong>MARCATE SI SEMNALIZATE CORESPUNZATOR.<\/strong> <\/em><\/font><\/font><\/p>\n<p align=\"justify\"><font face=\"Arial\" size=\"3\"><font color=\"#000000\" face=\"Arial\" size=\"3\"><em>Amenaj\u0103rile se pot executa numai dac\u0103:<\/em><\/font><\/font><\/p>\n<p align=\"justify\"><font face=\"Arial\" size=\"3\"><font face=\"Arial\" size=\"3\"><em><font color=\"#000000\" face=\"Arial\" size=\"3\"><em>a) se respect\u0103 culoarul destinat circula\u021biei pietonilor, stabilit potrivit normativelor \u00een vigoare, care nu poate fi mai mic de 1 m l\u0103\u021bime;<\/em><\/font><\/em><\/font><\/font><\/p>\n<p align=\"justify\"><font face=\"Arial\" size=\"3\"><font face=\"Arial\" size=\"3\"><em><font face=\"Arial\" size=\"3\"><em><font color=\"#000000\" face=\"Arial\" size=\"3\"><em>b) accesul vehiculelor \u00een parcare se realizeaz\u0103 din partea carosabil\u0103;<\/em><\/font><\/em><\/font><\/em><\/font><\/font><\/p>\n<p align=\"justify\"><font face=\"Arial\" size=\"3\"><font face=\"Arial\" size=\"3\"><em><font face=\"Arial\" size=\"3\"><em><font face=\"Arial\" size=\"3\"><em><font color=\"#000000\" face=\"Arial\" size=\"3\"><em>c) pozi\u021bionarea vehiculelor \u00een parcare nu st\u00e2njene\u0219te circula\u021bia pe prima band\u0103 sau pe pistele amenajate. <\/em><\/font><\/em><\/font><\/em><\/font><\/em><\/font><\/font><\/p>\n<p align=\"justify\"><font face=\"Arial\" size=\"3\"><font face=\"Arial\" size=\"3\"><em><font face=\"Arial\" size=\"3\"><em><font face=\"Arial\" size=\"3\"><em><font face=\"Arial\" size=\"3\"><em><font color=\"#000000\" face=\"Arial\" size=\"3\"><em>(3) Nu se pot amenaja parc\u0103ri pentru autovehicule, pe trotuar, la mai pu\u021bin de 10 m de intersec\u021bii, sta\u021bii ale mijloacelor de transport \u00een comun sau treceri pentru pietoni.<\/em><\/font><\/em><\/font><\/em><\/font><\/em><\/font><\/em><\/font><\/font><\/p>\n<p align=\"justify\"><font face=\"Arial\" size=\"3\">In completare, chiar dac\u0103 nu se refer\u0103 explicit la parcarea pe trotuar, mai exist\u0103 o reglementare (<a href=\"http:\/\/www.dreptonline.ro\/legislatie\/ordin_119_2014_norme_igiena_sanatate_publica_mediul_de_viata_al_populatiei.php\"><font color=\"#0000ff\"><strong>Ordin nr. 119\/2014<\/strong><\/font><\/a>) care nu permite amenajarea spa\u021biilor pentru parcare la mai pu\u021bin de 5 m de ferestrele locuin\u021belor. <\/font><\/p>\n<p align=\"justify\"><font face=\"Arial\">Pentru c\u0103 gazele eliminate de ma\u0219ini polueaz\u0103 aerul din locuin\u021be.<\/font><\/p>\n<p align=\"justify\"><font face=\"Arial\">Sau pentru c\u0103 se poate \u00eent\u00e2mpla s\u0103 cad\u0103 ceva de sus, de exemplu un morman de z\u0103pad\u0103 sau un sinuciga\u0219 \u0219i dac\u0103 vi se stric\u0103 ma\u0219ina pl\u00e2ngeti.<\/font><\/p>\n<p align=\"justify\"><\/p>\n<p align=\"justify\"><font face=\"Arial\" size=\"3\">In rezumat, trebuie s\u0103 re\u021binem urm\u0103toarele lucruri:<\/font><\/p>\n<p align=\"justify\"><font color=\"#000000\" face=\"Arial\" size=\"3\"><strong>1. Nu se mai poate parca pe trotuar dec\u00e2t dac\u0103 locul este marcat \u0218I semnalizat \u00een acest sens \u0218I locul l\u0103sat pentru pietoni are l\u0103\u021bimea de minim 1m. <\/strong><\/font><\/p>\n<p align=\"justify\"><font color=\"#000000\" face=\"Arial\" size=\"3\"><strong><font color=\"#000000\" face=\"Arial\" size=\"3\"><strong>2 Nu se mai poate parca \u0219i pe prima band\u0103 \u0219i pe trotuar pentru c\u0103 dac\u0103 ma\u0219ina ar fi par\u021bial pe carosabil ar st\u00e2njeni circula\u021bia pe prima band\u0103. <\/strong><\/font><\/strong><\/font><\/p>\n<p align=\"justify\"><font color=\"#000000\" face=\"Arial\" size=\"3\"><strong>3. Masinile nu pot fi parcate la mai pu\u021bin de 10m de intersec\u021bii<\/strong><\/font><\/p>\n<p align=\"justify\"><font color=\"#000000\" face=\"Arial\" size=\"3\"><strong>4. Masinile nu pot fi parcate la mai pu\u021bin de 5m de ferestrele locuin\u021belor (indiferent c\u0103 sunt parcate pe trotuar, pe carosabil sau pe o parcare amenajat\u0103).<\/strong><\/font><\/p>\n<p align=\"justify\"><font color=\"#000000\" face=\"Arial\">Aten\u021bie la \u0218I-uri, nu mai exist\u0103 alternativa ori marcaj, ori semnalizare ci pentru ca parcarea pe trotuar s\u0103 fie permis\u0103 sunt obligatorii toate condi\u021biile, deci <font color=\"#000000\">\u0218I<\/font> marcaj, \u0218I semnalizare \u0218I s\u0103 nu str\u00e2njeneasc\u0103 circula\u021bia pe prima band\u0103, \u0218I la nu mai pu\u021bin de 10 de intersec\u021bii, treceri de pietoni etc \u0218I la nu mai pu\u021bin de 5m de ferestrele locuin\u021belor.<\/font>&nbsp;<\/p>\n<p><a href=\"https:\/\/infokam.eu\/blog\/wp-content\/uploads\/2018\/03\/poz1-1.jpg\"><img loading=\"lazy\" decoding=\"async\" width=\"600\" height=\"357\" title=\"poz1\" style=\"display: inline; background-image: none;\" alt=\"poz1\" src=\"https:\/\/infokam.eu\/blog\/wp-content\/uploads\/2018\/03\/poz1_thumb-1.jpg\" border=\"0\"><\/a><\/p>\n<p><font color=\"#000000\" face=\"Arial\" size=\"3\"><\/font><\/p>\n<p><font color=\"#000000\" face=\"Arial\" size=\"3\"><\/p>\n<p><font face=\"Arial\" size=\"3\"><strong><br \/>\n<\/strong>Deci <strong><font color=\"#ff0000\">ma\u0219inile pot fi parcate pe trotuar numai dac\u0103 \u00eentreaga l\u0103\u021bime a acestora \u00eencape pe trotuar \u0219i mai r\u0103m\u00e2ne cel pu\u021bin 1 m pentru pietoni (de exemplu, pentru a parca o Dacia Logan trotuarul va trebui s\u0103 aibe o l\u0103\u021bime de minimum 3m), dac\u0103 locul este special amenajat, marcat \u0219i semnalizat, dac\u0103 e la mai pu\u021bin de 10 m de intersectii \u0219i la mai mult de 5 m de ferestrele locuin\u021belor.<\/font><\/strong><\/font><\/p>\n<p align=\"right\"><font face=\"Arial\" size=\"3\"><font face=\"Arial\" size=\"3\"><em>Anton Kovacs<\/em><br \/>\n<\/font><\/font><\/p>\n<p><\/font><\/p>\n<p><font color=\"#000000\" face=\"Arial\" size=\"3\"><\/font><\/p>\n<p align=\"justify\">\n<font face=\"Arial\" size=\"3\"><br \/>\n<\/font><\/p>\n<p align=\"justify\"><font face=\"Arial\" size=\"3\"><br \/>\n<\/font><\/p>\n<p align=\"justify\"><font face=\"Arial\" size=\"3\"><br \/>\n<\/font><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Mic ghid pentru uzul autorit\u0103\u021bilor Una din \u00eentreb\u0103rile care-I fr\u0103m\u00e2nt\u0103 din cele mai vechi vremuri pe rom\u00e2ni este dac\u0103 au voie sau nu s\u0103 parcheze pe trotuar.
